These Terms & Conditions (“Terms”) govern your access to and use of the Tandem service (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least the age of majority in your jurisdiction to use the Service. You are responsible for ensuring your use complies with all applicable laws and regulations.

Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate information and keep it up to date.

User content

You retain ownership of content you submit to the Service. You grant Tandem a worldwide, non-exclusive, royalty-free license to host, store, process, and display your content solely to provide and improve the Service.

Acceptable use

• Do not use the Service for unlawful, harmful, or abusive activity.
• Do not attempt to access accounts or data you are not authorized to access.
• Do not upload malicious content or interfere with the Service.

Third-party services

The Service may integrate with third-party services. Tandem is not responsible for third-party services and you use them at your own risk.

Beta service

The Service is in beta and may contain errors or interruptions. You acknowledge and accept that the Service is provided for evaluation purposes and may change or be discontinued at any time.

Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TANDEM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANDEM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. IN NO EVENT SHALL TANDEM’S AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU TO TANDEM FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR, IF NONE, ONE HUNDRED U.S. DOLLARS).

Indemnification

You agree to indemnify and hold harmless Tandem from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time.

Governing law

These Terms are governed by the laws of the jurisdiction where Tandem is established, without regard to conflict of law principles.

Changes

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
